In a no-fault divorce, marital misconduct is irrelevant to the determination of how your marital estate will be distributed. To obtain a divorce by consent in Pennsylvania, both spouses must submit signed affidavits stating that the marriage is irretrievably broken. Once they do, the court can grant a divorce if 90 days have passed since the divorce action was filed and served on the other party. However, if one party refuses to file an affidavit of consent, another option for obtaining a divorce is for the parties to be separated for two years. Following a two-year separation, the court, after a marital property has been distributed, will grant a divorce even if the other party does not consent to the entry of a divorce decree.
